3) It is the contention of Mr.A.R.Deshapnde, learned counsel for the appellant that having failed to comply with the offer made as per the terms of the auction, the Earnest Money Deposit (EMD) ought to have been forfeited.

4) We restrain the respondent No.1 Official Liquidator from releasing the EMD.
