The matter is mentioned on praecipe moved by the ApplicantsDefendants. 2.

In this Revision Application, there is challenge to order dated 12th January 2024 passed by the Court of Civil Judge, Senior Division - Malegaon. While passing the order, the learned Judge has exercised the power under Section 151 of the Code of Civil Procedure, 1908 ("CPC"). It is suit for partition and other reliefs. 3.

The trial Court directed the present Petitioners to pay monthly Satish Sangar 1/2

P-3-CRA-204-2024.doc maintenance of Rs.3,000/- (Rupees Three Thousand) till final disposal of the suit.

Now, the matter is fixed before the trial Court on 21st December 2024. It is submitted that this Court has issued a notice and it is also served privately. Affidavit is also filed. However, no one has appeared on behalf of the Respondents.

When the matter will be listed, the Court will ascertain, whether the service is effected or not. When, it is asked to learned Advocate, whether without prejudice, the Petitioners are ready to deposit the amounts, for want of instructions, she could not make a submission. 6.
