He has filed suit for cancellation of agreement for sale executed with the Defendants. It is on the ground of non-payment of entire sale consideration. During pendency of the suit, the Respondent No. 2, who claims to be purchaser of the flat has filed an application for impleadment. The trial Court allowed it as per Order dated 01.04.2024. The Plaintiff has challenged this Order. 3.

One of the submission made is Respondent No. 2 has not filed any document in support of his contention. In fact trial Court in para no. 5 of the impugned order has referred about registered sale deed in Seema 1/2
