Applicant is at liberty to raise all the grounds, including the ground of maintainability of the suit, at the time of settlement of issues and in the trial.

It is clarified that the observations made in the impugned order are limited to the extent of deciding the application under Order VII Rule 11 of the Civil Procedure Code, 1908. 4.
