Advocate Mr. Vivek Bhavthankar, the learned counsel appearing for the respondent no.3 has filed pursis stating that he has given notice to the clients (respondent no.3) about withdrawal of Vakalatnama on their behalf and said notice duly served upon the respondents on 12.11.2025. However, the respondent nos.2 and 3 have not approached him, hence, he do not want to continue to appear for respondent no.3.

Advocate Mr. Bhavthankar is permitted to file Vakalatnama for respondent no.2. Issue bailable warrant against the respondent no.3 in a sum of Rs.25,000/- made returnable on 23.04.2026. The P.I. of Degloor Police Station shall ensure to serve the bailable warrant against the respondent no.3/contemnor.

Needless to say that, the respondent no.2 duly served with the notice long back and also appeared through her counsel, however, till date no reply has been filed on behalf of the respondent no.2, whereas, other respondent nos.1, 3 and 4 have filed their replies. Therefore, there is presumption that the respondent no.2 has admitted the contents of the contempt petition.

The petitioner has prayed for taking action against all the respondents including the respondent no.2 under the Contempt of Courts Act and for non-compliance of judgment and order dated 23.03.2021 passed by the Appellate Authority. The respondent has not brought any material on record to show that there is compliance of said judgment and order. 5.

Therefore, I am of the prima facie view that the present respondent no.2 has committed Contempt of Court. Therefore, issue notice to the respondent no.2 in form no.A of Chapter No.34 of the High Court Appellate Side Rules made returnable on 23.04.2026. [Y.G. KHOBRAGADE, J.] mubashir
