The above Family Court Appeal challenges Order passed by the Family Court dated 21st January 2024 under which a divorce is granted to the Husband under Section 13(1)(ia) of the Hindu Marriage Act, 1955. Since above Family Court Appeal is coming up for the first time, the Registry is directed to issue notice to the Respondent returnable on 14th June 2024. In addition to the Court Notice, the Appellant is permitted to serve the Respondent with the papers and proceedings in the above Family Court Appeal by private notice as well.

In the meanwhile strictly without prejudice to the rights and contentions of the parties, as and by way of ad-interim relief, it is directed that the Respondent-Husband shall not remarry, if not already married.
