CIVIL APPLICATION FOR WITHDRAWAL OF AMOUNT 1.
The applicant seeks to withdraw an amount of Rs. 79,21,220/- deposited by the respondent-Acquiring Body.

The learned counsel Mr. Chavan submits that there is acquisition of land on large scale for Seena Kolegaon Project and in near about 500 matters the Acquiring Body committed with the Award passed by the Reference Court. The award of interest in the present case is also in accordance with law.

Learned counsel Mr. Koralkar for Acquiring Body submits that enhancement is more than 10 times.

Considering the submissions of the parties I find that interest of the parties would be subserved in withholding 20% of the amount and permitting the applicants/claimants to receive 80% of the amount. 5.
Civil Application is partly allowed permitting the applicant to receive 80% of the amount of compensation with accrued interest on furnishing undertaking to the satisfaction of the Registrar (Judicial) of this Court and balance 20% of the amount shall be invested in any nationalized bank. 6.
The Civil Application is disposed of.
CIVIL APPLICATION FOR STAY :

As the entire amount has been deposited by the Acquiring Body, ad interim relief granted earlier shall stand confirmed. 8.
