Mr. Tambe submits that this appeal arises out of the acquisition in file No.1997/LR/CR-56 i.e. for Diggi Storage Tank Tq. Omerga, District Osmanabad. Learned advocate for the applicant places reliance upon the order in CA No.1140 of

ca 996.25+.odt 2021 in FA ST 1970 of 2021. Mr. Tambe submits that in the connected matters arising out of the same acquisition, this court granted stay to the award passed by the Reference Court subject to deposit of 50% awarded amount and pursue this Court to pass similar order.

Considering the submissions advanced, and order dated 25.1.2021 passed in CA No.1140 of 2021, it is advisable to follow the same court.

Hence, there shall be ad-interim stay to the award passed by the Reference Court subject to the condition that the applicant deposits 50% of the awarded amount as passed by the Reference Court within a period of (12) Twelve weeks from today, failure to deposit the amount within stipulated period shall entail automatic vacation of the interim relief.
