The present civil application is filed for condonation of 138 days delay and for restoration of the petition.

Learned Advocate for the Applicant - Petitioner submits that, the petition came to be dismissed due to non-removal of the office objections pursuant to the conditional orders dated 04.12.2023 and 21.12.2023. He further submits that, insofar as the delay is concerned, the Applicant had no knowledge of the conditional orders and he came to know about the same for the first time in the last week of June, 2024, and immediately thereafter, he filed the present Application. 3.
Learned Advocate for the Applicant submits that, the Applicant is ready to remove the office objections. The delay caused in filing the Application is unintentional. If petition is not restored, irreparable loss would be caused to the Applicant. Hence, he submits that, the
Application be allowed.

Learned AGP appearing for the State opposed the Application and submits that sufficient time was granted to the Applicant to remove the office objections, however, the Applicant failed to do so and as a result, the petition was dismissed. It is further submitted that, the explanation offered for condonation of the delay is vague. Hence, he submits that, the Application be rejected.

Having regard to the above submissions and for the reasons stated in the Application, the Application is allowed. The orders dated 04.12.2023 and 21.12.2023 stand recalled. Delay of 138 days caused in filing the Application stands condoned. The petition is restored to its original stage. Application stands disposed off. In Writ Petition :

The Petitioner to remove office objections within a period of four
(4) weeks, failing which the earlier order/s of dismissal shall stand restored.
