THE STATE OF MAHARASHTRA THROUGH ITS SECRETARY AND OTHER Mr. T. Y. Sayyed, Advocate for the Applicants Mr. S. K. Tambe, AGP for the Respondent/State Mr. A. S. Bajaj, Advocate for Respondent Nos. 3 and 4 CORAM : RAVINDRA V. GHUGE AND R. M. JOSHI, JJ.

DATE : 18th MARCH, 2024 PER COURT :- 1.

This matter is on the production board in view of the urgency expressed by the learned Advocate for the Petitioners/Applicants. Grievance of the Petitioners is that despite the Petition filed in 2023, the Company has still not filed an affidavit-in-reply. This is likely to create grave hardship and manifest inconvenience to the Petitioners. It is further canvassed that, on the one hand, the Company is not filing the reply and on the other hand, the Company is proceeding to make fresh appointments.

2.

List this Civil Application along with the Writ Petition on 8th April, 2024. We expect the Company to enter its affidavit-in-reply on or 901.CA2505.24.odt

before 28th March, 2024, failing which the matters would proceed without the reply of the Company.

3.

If any recruitment takes place in the interregnum, no equities would be created in favour of the newly appointed persons and the said appointment shall be subject to the result of this petition. ( R. M. JOSHI, J. ) ( RAVINDRA V. GHUGE, J. ) ssp 901.CA2505.24.odt
