These are the applications for condonation of delay of 4378/ 4074 days caused for filing civil applications for restoration of first appeal and condonation of delay in filing first appeal. rrd

Learned counsel for the applicants submits that the delay in filing applications has been sufficiently explained and is supported by strong legal grounds and documentary evidence. It is high probability of success on merit, and also considered that the original records of the first appeal are currently untraceable, therefore, the applicant seeks leave to reconstruct the proceedings. Lastly, prayed to allow the applications. 4.
The learned AGP for the respondents has strongly opposed the applications and submitted that there is no sufficient reason to condone the delay.

Perused the applications.

For the reasons stated in the applications, the applications deserve to be allowed in the interest of justice as the delay is neither deliberate nor intentional. Hence, the order;
ORDER
(i) The civil applications are allowed.
(ii) The delay caused in filing the applications for restoration of first appeal and seeking condonation of delay in filing first appeal, is hereby condoned, subject to removal of office objections.
(iii) The office is directed to reconstruct the proceedings of appeal memos and other relevant documents.
(iv) The civil applications are disposed of.
