Applicants are seeking condonation of delay in setting aside abatement and in bringing legal heirs of deceased claimant no.3d Chhagabhai Dhondiba Kachkure on record. The legal heirs are necessary parties as the

( 2 ) 76 CA 13528 OF 2025 cause of action survives against them. The acquiring body should have taken steps but the claimants are coming forward for bringing legal heirs of deceased claimant no.3. It is desirable to condone the delay. 3.

Civil Application is allowed in terms of prayer clause "B", "C" and "D".

List this matter on 13.01.2026. If the acquiring body has not deposited the amount, the same shall be deposited with and stay granted earlier shall continued till then.
