CORAM : ROHIT W. JOSHI, J.
DATE : 12th AUGUST 2025 PER COURT :
1.
Learned Counsel for the Petitioners states that pursuant to the impugned judgment and order passed by the learned College Tribunal, the Respondent No.1 was reinstated in service, however, shortly thereafter, he tendered resignation. Learned Counsel for the Respondent No.1 does not dispute the statement. The dispute between the parties is now only with respect to back-wages. 2.
The learned Counsel for the Petitioners states that amount of back-wages as per last pay drawn by the Respondent No.1 will be deposited with this Court within a period of eight weeks from today
2 932.WP-5320-2022.doc and on this condition the effect and operation of impugned order may be stayed.
3.
The learned Counsel for the Respondent No.1 strongly opposes the request for grant of interim relief. He states that the contempt petition is scheduled to be heard before the learned Tribunal on 18.08.2025 and therefore the petition is circulated by the Petitioners at this stage and now unreasonable time of eight weeks is sought for depositing the back-wages.
4.
Having considered the submissions as aforesaid it is the considered opinion of this Court that it would be appropriate to allow the Petitioners to deposit the amount of back-wages with this Court within a period of six weeks from today. Subject to such deposit effect and operation of the impugned judgment and order passed by the College Tribunal, shall remain stayed. 5.
The interim order shall operate on the amount being deposited.
