The learned counsel for respondent No.1 pointed out that despite sufficient opportunity the applicant did not care to serve respondent Nos. 2 and 3. However, it appears that, respondent No.2 being the Municipal Council appears contesting party, since the dispute is regarding encroachment on D.P. Road. The notices issued to respondent Nos. 2 and 3 are still awaited. However, by abundant caution, issue fresh notices to respondent Nos. 2 and 3, returnable on 11.07.2025.
