The present application is filed seeking restoration of Writ Petition No.12158 of 2023 along with a prayer for condonation of delay of 138 days. 2.
The learned Counsel for the applicant submits that by a common order passed by this Court, the petitioner was directed to remove all office objections within a period of five weeks, failing which the petition was to stand dismissed without further reference to the Court. The petitioner failed to remove the office objections within the stipulated period and, consequently, the writ petition came to be dismissed. 3.
It is further submitted that the petitioner subsequently noticed that the writ petition had been dismissed and, thereafter, filed the present application seeking restoration. The learned Counsel submits that the delay is neither deliberate nor intentional, but is bona fide in nature. 4.
Considering the submissions made and for the reasons stated, the Civil Application is allowed. The delay of 138 days in filing the application is condoned, and Writ Petition No.12158 of 2023 is restored to its original position.
