The applicant seeks to condone the delay caused in filing the present appeal. The applicant is original claimant. He is litigating for getting just compensation towards injuries suffered in the accident. He is aggrieved by the assessment of compensation under the award.

Perused reasons for delay, particularly paragraph no.2 of the application. Delay is occasioned on account of financial difficulties and procedural aspects. Reasons as stated in the application are not controverted by the respondent by filing affidavit-in-reply.

In that view of the matter, application is allowed subject to condition that applicant files an undertaking to the satisfaction of the Registrar (Judicial) of this Court that he shall not claim interest for the delayed period in case his appeal for enhancement is favorably considered. Such an undertaking to be filed within a period of eight weeks from today. CA stands disposed of.
