Applicant is seeking condonation of delay of 2347 days in preferring appeal for enhancement of the compensation. Its an injury claim and only paltry compensation of Rs.25000/- was awarded by the trial Court. The delay is sought to be condoned on the ground mentioned in Paragraph Nos. 4 to 6 of the application. 2.

Respondent/Insurance Company has opposed the application by way of affidavit-in-reply.

I am of the considered view that a case is made out to condone the delay on certain conditions. There are no malafides on the part of the Applicant.

Civil Application is allowed in terms of prayer clause 'B' on

2 972(i).CA.12262-2024.doc condition of depositing cost of Rs.2000/- with the Advocate Bar Associations of the High Court of Aurangabad within four weeks from today.
