Learned counsel for the petitioners as well as counsel for the contesting respondents have pointed out orders dated 12th and 15th September, 2025 and jointly submitted that these matters were heard at length by this Court (Coram : R.M. Joshi, J.) and concluded the argument, and it was kept on 15th September, 2025 for further clarification about the query which this Court put to them. However, in the meantime, the assignment is changed, and therefore, learned counsel for the petitioners has moved praecipe along with learned counsel for the respondents and requested retention of these partially heard matters before the earlier Bench. Therefore, the order dated 15th September, 2025, passed by this Court, along 1 / 2

923-WP-1039-14.odt with the praecipe, was placed before the Hon'ble Chief Justice for further order.

The Hon'ble Chief Justice has requested the Registrar (Judicial) to direct the parties to approach the roster Bench, and if the roster Bench passes any order to place the matter before the earlier Bench, then forward the request with a copy of this order.

In view of this, today learned counsel for the parties appeared before the Court and urged for retention of these matters before the earlier Bench.

Considering the above submissions and the facts of the case, in my view, it would be appropriate to place the matter before the earlier Bench for further hearing. Hence, the Registrar (Judicial) is requested to place this order before the Hon'ble Chief Justice.
