Respondent Nos. 1 and 2 are served, but till today none has entered appearance for respondent Nos. 1 and 2 in the application filed for delay condonation.

The learned counsel for the applicant submits that the impugned order, dismissing the arbitration application by the District Judge was passed in covid-19 period when the matter was fixed for producing judgments and his advocate was not present. Thereafter, the advocate representing the applicant succumbed to covid-19 on 30.4.2021 and unfortunately it was not informed to the applicant about his demise. Thereafter, the applicant came to know about the passing of the order on 3.8.2024 and he filed the present application in September 2024. Considering the above, the learned counsel for the applicant prays to

CA 13379/24 allow the application filed for delay condonation in filing the arbitration appeal.

Respondents are served long back. However, they have not filed appearance. Since there is no contest to the proceeding of delay condonation and for the reasons stated in the application, the application filed for delay condonation is allowed. Delay caused in filing the application is condoned. Application is disposed of. 4.

Issue notice to the respondents in main matter, returnable on 29.4.2026.
