We have heard learned counsel for the parties on this contempt petition, which was alleged to the order dated 12th September 2023, and more particularly the observations as made by the court in paragraph 13, which reads thus:

"13. However, on instructions Mr Sakhare states that it should be possible to submit a redevelopment proposal within 12 months of the building being evacuated Previous benches have made similar orders with similar time frames and that is the only reason that we are inclined to accept this."

Reply affidavit on behalf of respondent nos.8 to 10 - contemnors, of Mr. Shripad Kulkarni, is filed wherein, in paragraph 6 in relation to the compliance Meera Jadhav

2/2 18-cp-34-25.doc of the court's orders the following statement has been made: "6. I say that thereafter Rachna Shilp, submitted the redevelopment plan with the Town Planner/ADTP Kalyan Dombivli Municipal Corporation on 24th September 2024 thereby requesting for the necessary development permission and Commencement Certificate. Annexed hereto and marked as Annexure "A3" is a copy of the covering letter dated 24th September 2024. The said proposal was duly received by the concerned Department of the Kalyan Dombivli Municipal Corporation.

I say that on 28th February 2025, the Town Planner Kalyan Dombivli Municipal Corporation addressed a letter to myself thereby stating that the proposal submitted on 24th September 2024 was scanned however, as per the UDCPR 2020 it is necessary to submit the proposal online so that proper action can be taken on the proposal. In the said letter it was further stated that the proposal which was submitted off-line was disposed of. Annexed hereto and marked as Annexure "A4" is a copy of the said letter dated 28th February 2025." It appears from the documents (Annexture-A3) as annexed to the affidavit that the compliance was appropriately undertaken within a period of 12 months. In this view of the matter, in our opinion, the contempt petition is not required to be taken any further.

Contempt petition is accordingly disposed of recording compliance. No costs.
