In view of the fact that, the learned Advocate for the respondent submits that in the present case, the proceedings is sought to be transferred from the Court at Sangamner to the Court at Kopargaon. Both the Courts are within the jurisdiction of learned District Judge, Ahmednagar. The applicant ought to have approached the learned District Judge for transferring of the proceedings. 2.

Learned Advocate for the applicant, on instructions, seeks leave to withdraw the application with liberty to approach the learned District Judge, Ahmednagar with the same prayer.
