Heard, the learned Counsel Mr. Sharma, appearing for the applicant-wife and Mr. Desale, learned Counsel appearing for the respondent husband.

By the present application, the applicant-wife seeking transfer of Hindu Marriage Petition No. 55 of 2023, from the file of learned Civil Judge, Senior Division, Panvel to the file of learned Civil Judge, Senior Division, Nandurbar, for disposal in accordance with the law.

Needless to say that, the applicant wife is residing at Bhimnagar, Navapur, Tq. Navapur, District Nandurbar, whereas, the non applicant-husband is residing at Kharghar, Navi Mumbai, Tal. Panvel, Dist: Raigad.

It is also not in dispute that, the non applicant-husband has filed a Hindu Marriage Petition, bearing No. 55 of 2023, seeking a decree of divorce. Since the applicant is residing in remote area, Taluka Navapur, and being a female, it will not be convenient for her, to attend the proceeding before the learned Civil Judge, Senior Division, Panvel. 5.

Therefore, considering the convenience of the applicant-wife, the Hindu Marriage Petition bearing No. 55 of 2023, is hereby withdrawn from the file of learned Civil Judge, Senior Division, Panvel and it is transferred to the file of learned Civil Judge, Senior Division, Navapur, District Nandurbar for trial and adjudication, in accordance with law. 6.

In view of the above, the Application is allowed and disposed of.
