By an order dated 12th April 2024, Writ Petition No.7363 of 2023 filed by Deepak Bhaskar Muthal and 10 other co-employees came to be disposed of and a direction was issued to the respondent no.6 to pay salary to them. In the order dated 12th April 2024, the following direction has been issued by the writ Court :

"3. That the grant is not received from the State Government cannot be the reason for the Respondent No. 6 not to pay the salary as due to the Petitioners. Being the primary employer, the Respondent No. 6 shall commence payment of the salary to the Petitioners, if they are working as on date, from 1 April 2024 onwards. As regards the arrears are concerned, this aspect would be considered on the next date. The Respondent No. 6 will not terminate the services of the Petitioners without seeking leave of this Court."

Alleging intentional and willful violation of the aforesaid direction issued by the writ Court, the present Contempt case has been laid by Deepak Bhaskar Muthal and 10 other co-employees. However, we are not 1/2 916-CP-95-2025.doc

Kartikeya Goti inclined to issue notice to the respondents for proceeding against them under the Contempt of Courts Act, 1971. We would rather proceed to dispose of this contempt case with a direction to the respondent no.6 to start payment of salary to the petitioners forthwith and file a compliance report in this Court within next four weeks, failing which a suo motu contempt case shall be registered against him. 3.

We have made this order having regard to the direction issued by the writ Court for payment of salary and considering the fact, as stated by the learned counsel appearing for the petitioners, that no application seeking review or modification of the order dated 12th April 2024 was filed.
