Heard the learned counsel for the Petitioner. 2.
The learned counsel submits that the Respondent Nos.3 to 10 have violated the Order dated 15th April 2024 passed by the Co-operative Court No.3, Mumbai. By Order dated 15th April 2024, Respondent Nos.3 to 10 were restrained from taken policy decisions with regard to any major businesses or issues pertaining to Opponent No.2-Society and its Managing Committee meetings, till decision of the dispute. 3.
The learned counsel for the Petitioner submits that though the said Order dated 15th April 2024 was set aside by 15th June 2026
51-CP-112-2025.DOC the Appellate Court on 22nd June 2024, during the operation of the Order dated 15th April 2024 of the Co-operative Court, the Respondents had issued a notice as to why the Petitioner should not be expelled from the society. He submits that this notice amounts violation of the Order dated 22nd June 2024 and seeks issuance of the contempt proceedings against the Respondents.

Considering that the Order dated 15th April 2024 was subsequently set aside and during the operation of Order dated 15th April 2024, there is no decision taken by the Respondent Nos. 3 to 13 on the notice for expulsion, no case for contempt is made out.

Considering the above, no case is made out to initiate contempt proceedings. The Petition is accordingly dismissed and disposed of.
