Heard Mr. Ghadge, learned Counsel appearing for the applicant wife and Mr. Shekade, learned Counsel appearing for the respondent husband.

By the present petition, the applicant wife prays for transfer of Hindu Marriage Petition bearing No. 153 of 2023 from the file of learned Civil Judge, Senior Division, Beed, to the file of learned Civil Judge, Senior Division, Ahmednagar.

Having regard to the submissions canvassed on behalf of both the sides, I have gone through the record. 4.

It is an admitted fact that, on 30.04.2015 the marriage between the applicant and non applicant was solemnized. However, subsequently, due to matrimonial dispute the applicant is residing at her

parental house, within the jurisdiction of Ahmednagar Court. Whereas, the non applicant is residing within the jurisdiction of the learned Civil Judge, Senior Division, Beed. It is also not in dispute that the applicant wife has already instituted two proceedings bearing Criminal Misc. Application No. 1002 of 2023 under the provisions of Protection of Women from Domestic Violence Act, 2005 and another petition bearing No. 102 of 2025 seeking maintenance and both are pending on the file of learned Family Court, Ahmednagar.

The Non Applicant is attending both these proceedings from his residential address. However, he has filed Hindu Marriage Petition bearing No. 153 of 2023 before the learned Civil Judge, Senior Division, Beed. Therefore, considering the convenience of both the parties, the Hindu Marriage Petition bearing No. 153 of 2023 pending on the file of learned Civil Judge, Senior Division, Beed needs to be withdrawn and it needs to be transfer to the file of learned Civil Judge, Senior Division, Ahmednagar. Hence I proceed to pass following order :

ORDER

(i) The Misc. Civil Application No. 149 of 2024 is allowed. (ii) The Hindu Marriage Petition bearing No. 153 of 2023 pending on the file of learned Civil Judge, Senior Division, Beed is hereby withdrawn and transferred to the file of learned Civil Judge, Senior Division, Ahmednagar.

(iii) This order be communicated to both the concerned Courts. ( Y.G. KHOBRAGADE, J.) mahajansb/
