This Petition is filed seeking initiation of action under article 215 of the Constitution of India R/W section 2 (b) & 12 of the Contempt of Courts Act, for flouting the Order passed by this Court dated 28.02.2023. 2.

In a group of first appeals this Court by the said Order directed the Special Land Acquisition Officer, Metro Centre No. 3 Panvel, to take steps to deposit the amount calculated as per the modified award within 4 weeks and thereafter to deposit the amount in the account of the Petitioner. The Petitioner has approached this Court pointing out that in spite of this Order the amount is not deposited. The Petitioner had infact also Shubham Talle 1/2

2 32-CP-152-2024.doc communicated the Order, the Petitioner thereafter even furnished the account details to the Special Land Acquisition Officer, for furnishing the bank details there was reference given of the Order passed by this Court. It is stated that inspite of such knowledge no action is taken. 3.

Issue notice to Respondents, returnable 26th March, 2024. Learned APP waives notice for Respondent Nos. 1 and 2. 4.

The Petitioner is at liberty to serve a copy by way of private notice to Respondent No. 1 personally.
