Heard the learned counsel appearing for the applicant. 2.

By the present application under Order 5 Rule 20 of C.P.C. the applicant seeks permission to serve the non-applicant by substitute service by paper publication on the ground that though the applicant has given correct address of the non-applicant, however, time and again the non-applicant with malafide intention has refused to accept the notice on one or the other reason. Though the applicant is residing at the given address within the jurisdiction of Pimpri Chinchwad Municipal Corporation. Therefore, the applicant is permitted to serve the non-applicant by publishing notice in Daily Punyanagari newspaper (Pune Edition).

Issue notice to the non-applicant by substitute service (paper publication) made returnable on 25.02.2026. The applicant shall bear the required publication charges and produce the newspaper on record. 4.
