This Contempt Petition has been filed for non-compliance of the order dated 21st August, 2019 passed in Public Interest Litigation No. 23 of 2011 by which the PIL preferred by the petitioner was disposed of with the direction to the Secretary, In-charge of the Minor and Major Irrigation Department of the State of Maharashtra to treat the PIL as representation and decide whether the percolation/minor irrigation tank needed to be constructed by the Zilla Parishad or by the Minor Irrigation Department of the State.

Admittedly, in compliance of the aforesaid order, the Secretary, In-charge of the Minor and Major Irrigation Department has decided that Soil and Water Conservation Department shall undertake the work of construction of percolation/minor irrigation tank needed to be constructed by

2-CP-378-2024.doc the Zilla Parishad. The directions contained in the order dated 21st August, 2019 have been complied with.

In the absence of any willful disobedience of the directions contained in the order dated 21st August, 2019, we are not inclined to proceed further with the Contempt Petition. However, liberty is reserved to the petitioner to take recourse to such remedy as may be available to him in law with regard to his grievance.

With the aforesaid liberty, the Contempt Petition is disposed of.
