The learned AGP submits that a perusal of order dated 14.03.2024 passed by District Collector, Nashik, would show that the applications of the petitioners filed under Section 28A of the Land Acquisition Act, 1894, have been dealt with on merits. If the petitioners are aggrieved by the findings, they ought to challenge the same on merits and that therefore, the present contempt petition does not deserve consideration.

We find that in paragraph No.4 of the said order of the Collector, it is held that since the applications of the petitioners filed under Section 28A of the aforesaid Act, are based on enhancement of compensation given by this Court, while allowing an appeal under Section 54 of the said Act, which was filed by the land owners covered under the same notification issued under Section 4 of the aforesaid Act, the said applications filed under Section 28A of the said Act, cannot be considered.

In reaching the said conclusion, reference is made to as many as 3 judgments passed by the Supreme Court. The learned AGP submits that he would study the said judgments and produce copies of the reported versions of the same, in order to assist this Court. The learned AGP may also produce the judgments of this Court on the aforesaid aspect of the matter.
