CORAM:
MADHAV J. JAMDAR, J.
DATED :
27th AUGUST 2024 P. C.:
1.
Learned Counsel appearing for the Respondent No.1 states that Ms. Deepali Mittal is a Director of M/s. A2Z Infra Management and Service Ltd. (Now known as A2Z Infraservices Ltd.). He states that said Ms. Deepali Mittal will remain present before this Court tomorrow.
2.
It is required to be noted that on 29th July 2016, a learned Single Judge has granted interim relief in terms of prayer clause (b) of Writ Petition No.898 of 2016, subject to the Petitioner furnishing an appropriate bank guarantee acceptable to the office of the Prothonotary and Senior Master of this Court for the amount of back wages up-to-date, in accordance with the impugned order. 3.
By the impugned order dated 12th February 2015 passed by the learned Presiding Officer, Industrial Tribunal, Mumbai in Reference (IT) No.6 of 2006, the 15 Security Guards were directed to be made permanent and they were directed to be given all the benefits of the permanency like other permanent workmen of the company from 26th April 2005 without any interest. The factual position makes it clear that an interim order has been secured from this Court without furnishing the bank guarantee. Accordingly, Ms. Deepali Mittal to remain present before this Court on 28th August 2024.
4.
It is made clear that if Ms. Deepali Mittal doesn't remain present before this Court tomorrow, then the Court will be constrained to pass orders to ensure her presence.
5.
Stand over to 28th August 2024.
