Heard Ms. Giri, learned Advocate for Petitioner through VC. 2.

Ms. Giri draws my attention to the order dated 05.01.2024 passed by the 10th Labour Court, Mumbai in Complaint (ULP) No.63 of 2023, inter alia, directing Respondents to pay 50% of the last drawn salary to Petitioner as part thereof as interim relief. 3.

She would submit that the said order was challenged before the Industrial Court in Appeal, but there is no stay granted by the Industrial Court. She would infact submit that when the matter was heard by the Industrial Court, Respondents were directed to comply with the said order since it was an order passed at the interim stage. 4.

On perusal of the said order and the averments made in the Contempt Petition, an arguable case has been made out by Ms. Giri for issuance of notice.

Hence, issue notice to Respondents. Humdast permitted. 6.

In addition to Court notice, Petitioner is permitted to serve a copy of the Contempt Petition and this order on the Respondents and inform them about the next date of hearing by any permissible mode of service and file appropriate Affidavit of service with tangible proof thereof on or before the next date.

After receiving notice, Respondents are directed to take cognizance of this order and file their Affidavit-in-Reply on or before the next date, if so desired.

Respondents are directed to remain present in Court on the next adjourned date either by themselves or through Advocate. 9.

Stand over to 13th November 2024.
