P.C.:
1.
Not on Board. Mentioned. Taken on Board.
2.
Heard Ms. Krishnaiyer, learned APP for the State. 3.
Ms. Krishnaiyer, learned APP appearing in the present Contempt Petition has filed praecipe dated 15.10.2024 seeking indulgence of the Court to reconsider expunging some of the directions which are passed in the order dated 09.10.2024 with respect to the functioning of the learned APPs' office and more specifically in the present matter.
4.
She would request the Court to expunge the directions which are contained in paragraph No.3 from line No.7 to line No.18 thereof. Though some of the observations made by the Court contained therein are actually factual observations, she would urge the Court to consider
her request to expunge the said remarks while giving assurance to the Court that there shall be no dereliction in the duty henceforth in the matters, which are assigned to her. She would submit that she was required to appear in the said matter on the said date, but due to her difficulty she could not appear. She would also inform the Court that there was some confusion with respect to the matter being a Contempt Petition which was missed by her.
5.
This Court is also not interested in passing directions against the learned APPs without any reason. All that this Court expects is their co-operation and assistance in the matters in which they are appearing. Next she would also request that the reference made to the learned PP in paragraph Nos.3 and 4 be kindly deleted as she has been instructed to appear in the present matter in the interest of justice as she has obtained appropriate instructions.
6.
There is no no reason to disbelieve that the learned APP will ensure that henceforth she will remain present in the matters when they are called out, in which she is appearing. 7.
In view of the earnest request made by the learned APP, it is directed that the sentence beginning with the words "I have perused ......." in line No.7 in paragraph No.3 upto line No.18 ending with the words "....... should be dispensed with / relieved" shall stand deleted and expunged in the order dated 09.10.2024.
8.
Similarly, the reference to "PP" in paragraph Nos.3 and "Chief PP" paragraph No.4 be read as "APP" only. 9.
The aforesaid corrections be carried out and a fresh copy of the order dated 09.10.2024 be uploaded.
10.
Needless to state that the directions contained in the order dated 09.10.2024 shall be strictly carried out by the learned APP. 11.
With the above directions, praecipe dated 15.10.2024 stands disposed.
