DATE : OCTOBER 23, 2024.
P.C.:
1.
Heard Mr. Nasikwala, learned Advocate for Petitioners and Ms. Barjiwala, learned Advocate for Respondent No.10. 2.
Mr. Nasikwala, learned Advocate has drawn my attention to the averments made in paragraph No.33 of the Contempt Petition and would submit that there is a breach of the status quo order granted by the Court on 06.08.2024. Present Contempt Petition is filed on 21.08.2024. Prima facie, on reading the contents of paragraph No.33 of the Contempt Petition it is seen that there appears to be an adequacy in the statement of facts.
3.
Be that as it may, Ms. Barjiwala, learned Advocate is appearing for Respondent No.10 since she has been served with the
38.cp.572.24.doc Contempt Petition. She would submit that, infact, the facts are to the contrary. In that view of the matter, she seeks to file Affidavit-inReply. Let the Affidavit-in-Reply be filed within one week from today in the Registry. Copy of the same shall be served on Mr. Nasikwala. Rejoinder, if any, to be filed within one week thereafter. 4.
Needless to state that all contentions of the parties including challenge to the maintainability of the Contempt Petition are kept open.
5.
Stand over to 27th November 2024.
