1.
Contempt is alleged of the order dated 25th October, 2024 by which this Court had directed the de-freezing of the account subject to deposit of 50% of the entire amount by the Petitioner. In the said order of 25th October, 2024, due to a typographical error instead of staying the "freezing order", the words "de-freezing order" came to be typed. It appears that taking advantage of the typographical error, the stand of the bank now is that there was no order directing the bank to de-freeze the account. sa_mandawgad 1 of
64cp601-24 2.
Prima facie, the stand is an incorrect stand adopted by the Bank particularly, considering that after the order of 24th October, 2024, the bank had de-freezed the account and permitted the Petitioner to operate the account and had thereafter, once again, on 30th October, 2024, frozen the account.
3.
Although, this Court was inclined to issue contempt notice, at the request of learned counsel for the Respondent-Bank in order to give an opportunity to the Bank to make its stand clear, stand over to 7th March, 2025. The Branch Head of the concerned bank to remain present on the next date.
