CORAM:

M.S. Sonak & Jitendra Jain, JJ.

DATED:

06 February 2025 PC:- 1.

This is not a case for initiating any contempt proceedings because the Petitioner had never impleaded the Special Land Acquisition Officer/22 (Pune) as a Respondent in the main Petition, which was disposed of by order dated 5 July 2023.

2.

The learned Counsel for the Petitioner now admits that the Special Land Acquisition Officer/22 (Pune) is the proper authority to dispose of the Petitioner's representation (the Petition itself was directed to be treated as a representation). 3.

At Exhibit M, the Petitioner has annexed the representation of July 2023 addressed to the Special Land Acquisition Officer/22 (Pune). We presume that along with

59-CP-626-24-F.DOCX the representation, the Petitioner has enclosed the copy of the Petition, which is to be treated as representation. 4.

In any case, we direct the Petitioner to once again submit a covering letter and a copy of the Petition to the Land Acquisition Officer/22 (Pune) within a week of today. 5.

On instructions, Mr Kedar Dighe, the learned Additional Government Pleader, states that the Land Acquisition Officer/22 (Pune) will dispose of such representation within five weeks of uploading this order. The Petitioner must also enclose an authenticated copy of this order along with his additional covering letter.

6.

All concerned to act upon an authenticated copy of this order.

7.

This Contempt Petition is disposed of in the above terms without any order for costs.
