IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CIVIL APPELLATE JURISDICTION CONTEMPT PETITION NO. 651 OF 2024 Dhananjay Jagannath Ghate.
... Petitioner.
Versus
Shri Santosh Patil & Anr.
... Respondents.
**** Mr. Hasan Khan, Advocate for the Petitioner. Mr. Ravindra S. Pachundkar, Advocate for Respondent Nos. 1 and 2. **** CORAM :
RAVINDRA V. GHUGE AND ASHWIN D. BHOBE, JJ.
DATE :
15th APRIL, 2025 P.C. :
1.
The Order of this Court, though belatedly has been implemented. An affidavit tendering an apology by appearing in the court in person by Shri Santosh Patil, District Collector, Satara, who was the then CEO of Zilla Parishad, Pune, has been accepted vide order dated 9th April, 2024.
2.
The Petitioner is not happy with the order. In contempt, we have to only see whether there is a willful, deliberate or intentional disobedience and if there is a delay, whether the apology tendered by the alleged contemnor is genuine. We find that the District Collector who in Talwalkar
7.CP651.2024.odt his capacity as CEO should have passed the order within a time line, appeared in this Court, tendered an apology and expressed his remorse and regret.
3.
Since the order of this Court is now been implemented, we do not find any reason to entertain this Petition any further. Contempt is purged. Petition is disposed off.
4.
Legal remedies, as may be available in law to the aggrieved parties, are kept open.
