DATE : 7 OCTOBER, 2025 P.C. :- 1) After the matter was argued for some time, both the learned advocates on instructions from their respective clients have consented to allow the present Miscellaneous Civil Application. 2) Miscellaneous Civil Application stands allowed in terms of prayer clause (a). The said prayer clause (a) reads as under :- (a) That this Hon'ble Court be pleased to transfer the divorce Petition being HMP No. 160 of 2019 pending before the Ld. C.J.S.D. at District Court Nashik to Ld. Family Court, Nashik Road, Nashik.

2.1) The Civil Judge Senior Division, Nashik, will transfer the

KVM 2/2 60 - MCA 13 OF 2025.doc proceedings of HMP No. 160 of 2019 to the Family Court at Nashik. 2.2) The Family Court, Nashik who is hearing Section 9 petition filed by the applicant-wife being Petition No. A-601 of 2019, will also hear the transfer Petition HMP No. 160 of 2019. 2.3) Both the proceedings would be heard by the one and the same Judge.

2.4) Mr. Prathamesh Bhanuwanshe i/b. Advocate Mr. Sanjay P. Shinde on instructions of his client submits that the arrears of maintenance are around Rs.13 lacs, would be cleared as soon as possible, as the respondent has applied for loan from HDFC Bank. The said submission made by the learned advocate for the respondent is accepted as an undertaking given to this Court. [RAJESH S. PATIL, J.]
