By this application, applicant/wife seeks transfer of marriage petition No. 143 of 2023 initiated by the respondent/husband pending before the Civil Judge Senior Division, Vadgaon Maval, Pune to Family Court at Nashik.

Learned counsel for the applicant submits that the applicant married the respondent on 28.12.2018 and one daughter is borne out of the said wedlock and the custody of the daughter is with the applicant. Due to certain matrimonial disputes, applicant is now staying with her parents at Nashik. The applicant is not employed and she is dependent on her parents. The distance between Maval, Pune to Nashik is about 250 km and that it would inconvenient for the applicant to travel to Pune to defend 1/2

S.S.Kilaje 18-MCA-26-24.doc the divorce proceedings initiated by the respondent/husband. She further submits that respondent is employed in private company and has sufficient capacity and to conduct the proceedings at Nashik. 4.

In view of the above facts stated, particularly that the applicant has a custody of four year old daughter and that she is dependent on her parents, it would be more appropriate to transfer the proceedings filed by the respondent/husband pending before the Civil Judge Senior Division, Vadgaon Maval, Pune to Family Court at Nashik. 5.

In view of the same, application is allowed. The proceedings bearing Marriage Petition No. 143 of 2023 pending before the Civil Court Sr. Division Vadgaon, Maval, Pune is transferred to Family Court at Nashik 6.

The Misc. Civil Application is disposed of.
