In the present proceeding, the Applicant - wife of the Respondent - husband is seeking transfer of proceeding under Section 9 of the Hindu Marriage Act, 1955 before the Family Court, Mirzapur (Uttar Pradesh) to the Family Court, Bandra, Mumbai. 2.

The present proceeding is filed under Section 24 of the Code of Civil Procedure, 1908 ("CPC") seeking transfer. In my view, such transfer proceeding from one State to another State can only be filed under Section 25 of the CPC.

On the last occasion i.e. on 12.09.2025, learned Counsel for the Applicant who had not supplied a memo of the Application for effecting service on the Respondent was directed to supply a memo of the Application in the registry of this Court and also serve the Anand

24. MCA 27-2025.doc Respondent by a private service. She was about to pay costs of Rs. 2,500/- voluntarily with the Kirtikar Law Library. Office remarks shows that neither any memo of the Application is supplied in the registry of this Court nor any intimation of payment was given, hence notice could not be issued to the Respondent. 4.

The Miscellaneous Civil Application stands disposed of for want of prosecution.
