ORDER
(A) Miscellaneous Civil Application is allowed in terms of prayer clause (a) which reads as under :- (a) That This Hon'ble Court be pleased to transfer the proceedings pending Civil M.A. NO. 91/2022, which is before the Sr Civil Judge (JD) at THANE AND also transfer petition bearing RCS no 200 of 2024 before at Civil Judge J.D. at Vasai club with and and Domestic violence act application 91/2022 pending before 12th Judicial Magistrate 1st
KVM 2/2 11 - MCA 55 OF 2025.doc class at Bandra/club with A petition 2224 of 2023 as the matter filed for DIVORCE U/S 27(D) And 37 OF SPECIAL MARRIAGE ACT, 1956 at Family court at Bandra at court room no.3.
(B) Hearing of Civil Misc. Application No. 91 of 2022 (custody petition) is expedited. An endevour to be made by the learned Judge to dispose of the same as early as possible and in any case, within a period of one year from today.
(C) Without prejudice to the rights and contentions of both the parties, the Respondent (husband) will pay directly in the bank account of the Applicant (wife), a sum of Rs.15,000/- per month between 1st to 5th day of every month starting from October 2025, till the Maintenance Application filed by the wife is decided by the Family Court. 2) For the sake of clarification, it is stated that, the amount which will be paid by the Respondent husband at the rate of Rs.15,000/- per month would be adjusted against the payment order being made by the Family Court Judge in the Maintenance matter.
