DATE : 8 DECEMBER, 2025 P.C. :- 1) Mr. Amol Kakad, learned advocate submits that he has instructions to appear on behalf of the respondent-husband. He submits that he has specific instructions that his client, the respondent wants to withdraw the Petition No. 349 of 2023 pending before the Family Court at Aurangabad, which was filed by the respondent seeking restitution of conjugal rights. He submits that the said proceeding could not be withdrawn as this Court in the present proceeding has granted ad-interim relief by order dated 10 September, 2025.

2) In order to enable the respondent to withdraw the

KVM 2/2 40 - MCA 91 OF 2024.doc Petition No. 349 of 2023 filed before the Family Court at Aurangabad, ad-interim relief granted by this Court stands vacated to the limited extent to enable the respondent-husband to withdraw Petition No. 349 of 2023 filed before the Family Court at Aurangabad. 3) The submissions made by Mr.Kakad on behalf of his client, respondent-husband that he will be withdrawing Petition No. 349 of 2023 pending before the Family Court at Aurangabad is accepted.

4) In view of the same, the present Miscellaneous Civil Application becomes infructuous.

5) The present Miscellaneous Civil Application stands disposed of in view of the withdrawal of the Petition with liberty to the applicant-wife to file appropriate application in case the respondent files a fresh petition.

6) The Registrar (Judicial-I) is hereby directed to communicate the order passed today to the Registrar of the Family Court at Aurangabad by E-mail.
