Heard Mr. Yadav, learned Advocate for Applicant and Ms. Sharma, learned Advocate for Respondent.

This case is considered as a test case. On 02.07.2024 order is passed when both parties expressed and gave their consent for going for mediation. This Court directed the Co-ordinator, High Court, Main Mediation Center, Mumbai to appoint a mediator form their panel. Registry was directed to communicate the said order to the Coordinator, High Court, Main Mediation Center, Mumbai. 3.

Parties received letter dated 18.07.2024 directing the parties to attend the mediation meeting in the Mediation Center at Panvel. This is what is informed to me across the bar by both the Advocates.

Present Application seeks transfer of Marriage Petition from Family Court, Thane to Family Court, Pune. The process of mediation is required to ease inconvenience to the parties. In this case, learned Mediator was directed to conclude the mediation proceedings within four weeks and thereafter submit report to this Court. Parties have informed me that when they approached the Mediation Center at Panvel, they were informed that they have not received any communication from the Main Mediation Center in Mumbai and that they will communicate the Main Mediation Center in Mumbai and thereafter apprise the parties. Till date, the parties have not been apprised at all and the matter is listed before me not because of any direction given previously but because this roster has been transferred to my assignment and I have directed that all Misc. Civil Applications will be listed in seriatim according to their date of filing. 5.

In view of the above, the Co-ordinator, High Court, Main Mediation Center, Mumbai is directed to see me in my chamber along with an explanation as to why the parties in the present case were issued a letter to attend the Mediation Center in Panvel when the parties have no nexus whatsoever with Panvel. 6.

Registry shall communicate this order to the Co-ordinator, High Court, Main Mediation Center, Mumbai.

7.

Ad-interim relief if any, granted earlier shall continue in the meanwhile.

Stand over to 6th September, 2024.
