Heard Mr. Waghmare, learned Advocate for Applicant and Mr. Zade, learned Advocate for Respondent.

The Application seeks transfer of Marriage Petition No.544 of 2023 instituted by the Respondent in the Court of Civil Judge Senior Division, Taluka - Baramati, District- Pune to the Family Court, Bandra, Mumbai.

The Applicant is the wife having an 18 month old child. The grounds of hardship are evident on reading paragraph Nos.4(a) to 4(g). There can be no impediment in allowing the Application. The Respondent himself is working in Mumbai Police. Convenience of the Applicant deserves paramount consideration while considering transfer. Proximity of distance and nurturing an infant are factors which require immediate consideration.

915.MCA.162.2024.doc Application therefore stands allowed in terms of prayer clause (a) which reads thus:- "(a) that this Hon'ble Court be pleased to transfer the proceedings of Hindu Marriage Petition No.544 of 2023 for divorce u/s.13(l)(i)(a) of Hindu Marriage Act, 1955 filed by the Respondent pending before the Court of Ld. Civil Judge Senior Division, Baramati, Pune to Family Court, Bandra, Mumbai."

Mr. Zade, learned Advocate for the Respondent is permitted to file his Vakalatnama which shall be filed in the Registry within a period of one week from today. Registry is directed to accept the same.

With the above directions, Miscellaneous Civil Application is disposed.
