The applicant (husband) herein has filed the Petition No. A-36 of 2023 for divorce before the Family Court at Nashik. By this application he is seeking transfer of the said petition filed by him to the Court of Civil Judge Senior Division, Malegaon Dist. Nashik, on the ground that the Petition filed by the wife for restitution of conjugal rights is pending there. 2.

I have heard the learned counsel for the applicant. To avoid conflicting decision, it would be appropriate to allow the present application. Hence, the following order is passed :
