DATE : 18 SEPTEMBER, 2025 P.C. :- 1) Ms. Joshi, learned advocate appearing for the applicant (wife) submits that the present Miscellaneous Civil Application needs to be withdrawn with liberty to the applicant to prefer an appropriate application if the Marriage Petition No. 395 of 2024 which was filed by the respondent before the Family Court, Belapur is restored back to the file. She submits that the applicant wife is staying alongwith her two school going daughters at Malegaon. She has filed three proceedings against the respondent at Malegaon. It is difficult for the applicant to travel to Belapur, as the time to commute is around 10 hours. However, since the marriage Petition No. 395 of 2024 filed by

KVM 2/2 3 - MCA 184 OF 2024.doc the respondent husband before the Family Court at Belapur was dismissed for default on 21 August, 2025, the present petition will automatically becomes infructuous. If the said petition for some reason is restored for back to file, the applicant seeks leave and liberty to file a fresh transfer proceedings under Section 24 of the Code of Civil Procedure.
