Without delineating on any merits of the matter, I have heard Mr. Pillai and Ms. Umale on VC from Nagpur, learned Advocates for the respective parties. After hearing them briefly, both of them would jointly submit that an opportunity be given to the parties to mediate and they should be sent for mediation so that an attempt can be made to reconcile the dispute between them. Undoubtedly, this can be done without prejudice to their rights and contentions. 2.

Hence, adhering to the request of the parties, I appoint Mr. Rajeev Patil, Learned Senior Advocate, practicing in this Court to act as a Mediator and assist the parties in resolving their dispute. It is seen that 1 / 3

in the present case, parties have been married for the last twelve years and had been living together for more than 9 years and in that view of the matter there is a realistic chance that they can come together as informed by the learned Advocates. The parties do not have any issue also.

In view of the above, by consent of parties, Mr. Rajeev Patil, learned Senior Advocate is appointed as Mediator. 4.

Parties are directed to approach the learned Mediator to fix the schedule of dates of meetings and shall extend complete cooperation. learned Advocate Applicant for shall coordinate with the parties and the learned Advocate for Respondent both for extending information of the mediation meetings that shall be convened by the learned Mediator. 5.

It is directed that the costs of mediation and Mediator's fees and charges shall be borne equally by the Applicant and Respondent. 6.

Learned Mediator is requested by this Court to submit his report to this Court on or before 25th October, 2024. 7.

Learned Mediator shall be at liberty and is permitted by this Court to call for any such relevant documents from the parties and if so called for, the parties are directed to produce the same before the 2 / 3

learned Mediator. Parties to act on an authenticated copy of this order. 8.

Stand over to 25th October, 2024.

Since the Respondent wife is from Nagpur and it would be inherently difficult for her to travel all the way from Nagpur along with Ms. Umale, her Advocate, the Learned Mediator and the Mediation Center both are requested by this Court to permit the Respondent and Ms. Umale to appear on VC. For the sake of convenience, Mr. Pillai, learned Advocate for the Applicant is requested by this Court to facilitate the meetings and convey the details of the meetings to Ms. Umale on time.
