The learned counsel appearing for the respondent-husband submits that the custody of the child is with the mother and the order of visitation rights are not being complied with. She also submits that when the respondent-husband had travelled to Pune, a case under Section 354 of the IPC was registered against him only with the intent to avoid the respondent-husband from meeting the child. The custody of the child is misused by the applicant to pressurise and prevent the respondent-father from meeting the child.

Let an affidavit be filed by the applicant responding to the submissions of the respondent-husband.
