Heard Mr. Agarwal, learned Advocate for Applicant through Video Conferencing and Mr. Haldankar, learned AGP for Respondent No.1 - State of Maharashtra.

Record indicates that Respondent No.2 is not been served atleast there is no Affidavit of service filed. Though there are several Court notings regarding service awaited.

One of the grievance expressed by Mr. Agarwal that proceedings have been physically handed over to Respondent No.2 during hearing of proceedings under the Protection of Women from Domestic Violence Act, 2005 (for short 'the said Act') in Family Court, Solapur

However since Affidavit of service is not filed, I am directing the Applicant / Advocate for Applicant to serve Respondent No.2 by any permissible mode of service and file appropriate Affidavit of service to that effect which shall be considered by the Court for deciding the present Miscellaneous Civil Application. 5.
If Respondent No.2 is served he is directed by this Court to attend the hearing on the next adjourned date, failing which this Court shall not await his presence and response and decide the Miscellaneous Civil Application in accordance with law.
