Heard learned Advocate for the Applicant-Wife. She has filed a Restitution Petition before the Solapur Family Court. Whereas, the Respondent-Husband has filed a Divorce Petition before the Court of Civil Judge Senior Division at Sangli. This Application is for transfer of Divorce Petition from Sangli to the Family Court at Solapur. 2.

Notice is issued through Court to Respondent on the address at Sangli. It returned with the remark "he is not staying there and staying at Pune for job". The Applicant-Wife is not aware about Pune address. She was allowed to serve the Respondent by alternate mode including Satish Sangar 1/2

4-MCA-231-2024.doc Whats-App. It is done. Service affidavit is filed. Page Nos.6 and 7 are the extracts of Whats-App messages sent to him. Page No.7 denotes the messages received by him. The date of appearance was 6th September 2024. Thereafter, he has not appeared. 3.

Convenience of the wife is important. Hence, order:-

O R D E R

(i) The Application is allowed in terms of prayer clause (b). (ii) HMP No. 4 of 2022 pending in the Court of Civil Judge Senior Division - Sangli is transferred to the Family Court - Solapur.
