Heard Mr. Bagkar, learned Advocate for Applicant. 2.
At the outset Mr. Bagkar would inform the Court that Hindu Marriage Petition No.119 of 2020 pending before the learned Civil Judge, Senior Division, Alibag (Camp Mahad) of which transfer was sought by the Applicant to learned Civil Judge, Senior Division at Kolhapur has been decided by the Trial Court. He would submit that on 08.07.2024 when Miscellaneous Civil Application was heard by the Court, this fact was not known to the Advocates and it was only subsequently brought to their notice. In this view of the matter, Mr. Bagkar would submit that Miscellaneous Civil Application has become infructuous.

Mr. Bagkar however persuades the Court to grant one indulgence. He would submit that the Application has preferred an Application before the Court of Civil Judge, Senior Division, Alibag
904.MCA.263.2024.doc (Camp Mahad) with respect to the Petition which has been decided by the Trial Court. He would submit that some direction be passed for the hearing of the said Application. Considering that the request is coming from the Applicant who is a lady and she herself is staying at Kolhapur, the learned Trial Court is directed by this Court to consider the Application that is filed by the Applicant and decide the same strictly in accordance with law after hearing both the sides as expeditiously as possible and pass a speaking order therein.

With the above directions, Miscellaneous Civil Application having become infructuous is dismissed.
